I live in NM and until just a few years ago it was legal to ride unsecured in the back of pick-up trucks. Lots of people did it with their kids and construction workers could be seen on a daily basis riding in the back end of the boss' truck out to the work sites.

The reason it stayed legal for so long is because of the agricultural trade.
For example, if you had to bale and transport a sixteen four of alfalfa in 1980, you did it with four guys, a pickup truck and trailer. When you're finished baling and loading, you have a full trailer, a half full truck and two guys that don't fit in the cab. So you stick 'em in the bed. You're only going to do 15mph anyway, you didn't lash the load.
It's still legal many places. That's not to say it's a good idea, at all.
